Rashi explains the words ืœึทื”’ ืึฑืœึนืงึถื™ืšึธ to mean: ืœืฉืžื• ื•ื‘ืฉื‘ื™ืœื•. The Mishnah, at the end of Sanhedrin, states that carrying out the mitzvah of wiping out an ir nidachas is on par with bringing a korban:

The Gemara (Sanhedrin 71) cites the following teaching of Rโ€™ Eliezer:

If a city contains even one mezuzah, it cannot become an ir hanidachas, because an ir hanidachas has to be destroyed completely, but itโ€™s assur to erase Hashemโ€™s Name, and a mezuzah has Hashemโ€™s Name in it. An ir hanidachas is a place where everyone has strayed so far in worshipping avodah zarah that not a single mezuzah could be found in it.

Rabbi Akiva Eiger, the Minchas Chinuch, and other Acharonim wonder why the principle of ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื” would not apply in this case. The Gemara says, in Yevamos, that in Mishneh Torah, Sefer Devarim, we derive new halachos from smuchin, phrases that are juxtaposed. Since the mitzvah of tzitzis is juxtaposed with the prohibition of shatnez we derive that ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื”, and shatnez in tzitzis is permitted โ€“ one may place strings of wool on a linen garment.

Incidentally, we have a mesorah from Rav Asher Arielli shlita that whenever the Rambam discusses a particular sugya you shouldnโ€™t just look up the words of the Rambam that are relevant to that sugya โ€“ rather, you should start learning from the beginning of the perek in the Rambam to see the larger context. He quips thatื‘ืžืฉื ื” ืชื•ืจื” ื“ืจืฉื™ื ืŸ ืกืžื•ื›ื™ืŸ โ€“ in the Rambamโ€™s Mishneh Torah you darshen smuchin, seeing whatโ€™s before and after the halachah in question in order to fully understand the sugya.

In any event, the Acharonim grapple with the question of why the mitzvas asei ofื•ึฐืฉื‚ึธืจึทืคึฐืชึผึธ ื‘ึธืึตืฉื ืึถืช ื”ึธืขึดื™ืจ does not override the lo saaseh of ืœึนื ืชึทืขึฒืฉื‚ึถื” ื›ึตืŸ ืœึทื”’ ืึฑืœึนืงึถื™ืšึธ. They suggest that a mezuzah contains many Names of Hashem, so destroying a mezuzah would involve numerous lavin, and an asei does not override numerous lavin. Furthermore, they explain, the lav of erasing Hashemโ€™s Name also involves an asei โ€“ that of ืึถืช ื”’ ืึฑืœึนืงึถื™ืšึธ ืชึผึดื™ืจึธื โ€“ and an asei does not override a lo saaseh and an asei.

Rav Eliezerโ€™s Exception

The Pardes Yosef offers a different explanation. There is a machlokes between Beis Shammai and Beis Hillel over the principle of ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื”, and Beis Shammai maintains that we do not apply this concept to tzitzis, and that shatnez in tzitzis is forbidden. Rโ€™ Eliezer was a Shamuti, a talmid of Beis Shammai, and he is the one who says that a city with even one mezuzah cannot become an ir hanidachas. Since Beis Shammai does not agree with the principle ofืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื”, we cannot destroy an ir hanidachas if it contains even one mezuzah.

There is a problem with this explanation, however, because Rโ€™ Eliezer himself, in Maseches Nazir, clearly holds that ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื”. Furthermore, besides the juxtaposition of tzitzis and shatnez being a source of ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื”, the Gemara suggests several other possible sources. In the end, the Gemara rules out each of those other sources, leaving only the juxtaposition of tzitzis and shatnez, which Beis Shammai disagrees with. Interestingly, however, all of the Gemaraโ€™s other attempts to find a source for ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื” do work according to Beis Shammai.

One of those attempts, for instance, is to derive ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื” from nazir, but the Gemara nixes that possibility because of the halachah that a nazir may be matir neder: ื“ืฉืื ื™ ื ื–ื™ืจ ื“ื™ืฉื ื• ื‘ืฉืืœื”, which makes nazir less stringent than other prohibitions. Yet Beis Shammai holds that a nazir may not be matir neder โ€“ ืœื‘”ืฉ… ืื™ืŸ ืฉืืœื” ื‘ื”ืงื“ืฉ โ€“ in which case we could derive the principle of ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื” from nazir.

Another suggestion in the Gemara is that this principle can be derived from the Korban Tamid, which overrides Shabbos, but the Gemara strikes down that possibility on the grounds that the commandment of the Korban Tamid was given before Mattan Torah. This is only true, however, if the Korban Olah that Bnei Yisrael brought in the Midbar was a Korban Tamid, but Beis Shammai holds that it was actually an Olas Reโ€™iyah. Accordingly, Beis Shammai would see this as a legitimate source for ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื”.

Similarly, the Rishonim in Yevamos discuss whether ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื” can be derived from the combination of nazir and kohen. Tosafos says: ื•ื›ืœ ืฉื ื™ ื›ืชื•ื‘ื™ื ื”ื‘ืื™ื ื›ืื—ื“ ืื™ืŸ ืžืœืžื“ื™ืŸ, but we know that Shammai Hazaken holds: ืฉื ื™ ื›ืชื•ื‘ื™ื ื”ื‘ืื™ื ื›ืื—ื“ ืžืœืžื“ื™ืŸ.

Accordingly, we would have to invalidate the suggestion that the reason Rโ€™ Eliezer did not apply the principle of ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื” to mezuzah and ir hanidachas is because he is a talmid of Beis Shammai.

The Correct Viewpoint

Thereโ€™s much more to this pilpul, but I want to bring out a mussar haskel from this sugya.

The story is told that in Yerushalayim of old there were two brothers, one a big kanaโ€™i, and the other an ohev shalom. A certain gadol said about these two brothers that they each have their own individual path in avodas Hashem, and the difference in their respective approaches is reflected in the following scenario. Imagine, he said, that there was a report about an ir hanidachas somewhere in Eretz Yisrael. If the brother who was a kanaโ€™i would hear that there was one mezuzah in the city, he would say, โ€œOy, so now theyโ€™re going to get saved,โ€ and he would go and remove the mezuzah in order to fulfill the mitzvah of wiping out an ir hanidachas. But if the other brother would hear that there is a city thatโ€™s an ir hanidachas, he would go and put up mezuzah to save the city.

This concept of one mezuzah saving an entire city is a fundamental idea that is reflected in the opening words of the parashah as well. Many of the Acharonim note that there is a change in subject in the words: ืจึฐืึตื” ืึธื ึนื›ึดื™ ื ึนืชึตืŸ ืœึดืคึฐื ึตื™ื›ึถื ื”ึทื™ึผื•ึนื โ€“ the word ืจึฐืึตื” is addressed to the singular โ€œyou,โ€ while the word ืœึดืคึฐื ึตื™ื›ึถื is addressed to the plural โ€œyou.โ€ The Chasam Sofer explains that this indicates that each person should view the world as if itโ€™s half guilty and half meritorious. If he does an extra mitzvah โ€“ one mezuzah, one chessed, one good deed โ€“ he sways the entire world to the side of merit, and if he transgresses, he sways the world to the other side. From ir hanidachas we see this clearly: one mezuzah could change the fate of the entire city.

Another way of understanding the words ืจึฐืึตื” ืึธื ึนื›ึดื™ is that a person has to view himself with the correct outlook. He has to see himself as a ื—ืœืง ืืœื•’ ืžืžืขืœ, a representative of

ืึธื ึนื›ึดื™ ื”’ ืึฑืœึนืงึถื™ืšึธ โ€“ and not, as the Kotzker said, fall into the category of ืึธื ึนื›ึดื™ ืขึนืžึตื“ ื‘ึผึตื™ืŸ ื”’ ื•ึผื‘ึตื™ื ึตื™ื›ึถื. Sometimes a personโ€™s anochiyus becomes a barrier between him and Hakadosh Baruch Hu, and to prevent that from happening, a person has to develop hisbatlus and view himself in the right way.

The word ืจึฐืึตื” has the same gematria as ืื•ืจ and ืจื–, which alludes to the concept that a person should see himself with the correct hashkafah and understand what his true purpose is so that he can make proper decisions. The whole dilemma of whether or not we apply the principle of ืขืฉื” ื“ื•ื—ื” ืœื ืชืขืฉื” is rooted in the dilemma over what youโ€™re not allowed to do and what youโ€™re supposed to do, which is reflected in the passuk: ืจึฐืึตื” ืึธื ึนื›ึดื™ ื ึนืชึตืŸ ืœึดืคึฐื ึตื™ื›ึถื ื”ึทื™ึผื•ึนื ื‘ึผึฐืจึธื›ึธื” ื•ึผืงึฐืœึธืœึธื”. Thereโ€™s no in between; you have to make a decision.

But we can also explain the words ืจึฐืึตื” ืึธื ึนื›ึดื™ ื ึนืชึตืŸ ืœึดืคึฐื ึตื™ื›ึถื ื”ึทื™ึผื•ึนื ื‘ึผึฐืจึธื›ึธื” ื•ึผืงึฐืœึธืœึธื” in a different way. Brachah is brachah, but ื•ึผืงึฐืœึธืœึธื” can be interpreted as an acronym for the words:ื•ื”ืงืจืŸ ืงื™ื™ืžืช ืœื• ืœืขื•ืœื ื”ื‘ื. When a person does mitzvos, he enjoys the fruits of his good deeds in this world, but the principal remains intact for Olam Haba. The Torah is telling us that everything is good โ€“ on Olam Hazeh youโ€™ll get brachah, and even the klalah is a promise of rewards in Olam Haba.

We should all be zocheh.
