In this weekโ€™s parashah, Hakadosh Baruch Hu tells Moshe Rabbeinu to go down from Har Sinai because Klal Yisrael has made an eigel:ืœึถืšึฐ ืจึตื“ ื›ึผึดื™ ืฉืึดื—ึตืช ืขึทืžึผึฐืšึธ… ืขึธืฉื‚ื•ึผ ืœึธื”ึถื ืขึตื’ึถืœ ืžึทืกึผึตื›ึธื” ื•ึทื™ึผึดืฉืึฐืชึผึทื—ึฒื•ื•ึผ ืœื•ึน ื•ึทื™ึผึดื–ึฐื‘ึผึฐื—ื•ึผ ืœื•ึน. When Moshe descends and sees the eigel, he throws down the luchos and breaks them. Rashi, citing the Gemara (Yevamos 62a), says that Moshe Rabbeinu did three things of his own accord that Hakadosh Baruch Hu approved of, and one of those was breaking the luchos. The Gemara explains that Moshe Rabbeinu reasoned that if the Korban Pesach, which is just one of the 613 mitzvos, may not be eaten by a mumar ย โ€“ ื›ึผึธืœ ื‘ึผึถืŸ ื ึตื›ึธืจ ืœึนื ื™ึนืื›ึทืœ ื‘ึผื•ึน โ€“ then certainly if Klal Yisrael are mumarim, they do not deserve to get the entire Torah. Therefore, he broke the luchos.

Why, asks the Maharsha, didnโ€™t Moshe Rabbeinu make this drashah already in shomayim, when Hakadosh Baruch Hu told him to descend because Klal Yisrael were worshiping the eigel? Why did he go down and break the luchos, rather than leaving them in shomayim?

The Maharsha gives two answers. One is that Moshe Rabbeinu wanted to teach us a very important halachah โ€“ that beis din may issue a verdict only on the basis of the testimony of two witnesses. One witness, no matter how trustworthy he is โ€“ in this case, the one witness being Hakadosh Baruch Hu Himself โ€“ cannot be relied upon for a psak. Moshe Rabbeinu could not reach the verdict that the luchos should be broken based on the testimony of even Hashem Himself. Only when he descended and saw himself what was going on โ€“ rendering eidus unnecessary โ€“ did he decide to break the luchos.

The Maharshaโ€™s second answer, based on the Sefer Haโ€™ikrim, is that when a person sees something with his own eyes, he feels much more distress than when he hears about it. Seeing something painful hurts much more than merely knowing about it. Itโ€™s not clear exactly what he means by this, but the Maharsha ends off by saying: ืขื™ื™ืŸ ื‘ื–ื” ื‘ืฉืืจ ืžืคืจืฉื™ ื”ืชื•ืจื”.

Perhaps we can suggest another two possible answers to this question.

Spurring Teshuvah

The last words of the Torah are: ื•ึผืœึฐื›ึนืœ ื”ึทื™ึผึธื“ ื”ึทื—ึฒื–ึธืงึธื” ื•ึผืœึฐื›ึนืœ ื”ึทืžึผื•ึนืจึธื ื”ึทื’ึผึธื“ื•ึนืœ ืึฒืฉืึถืจ ืขึธืฉื‚ึธื” ืžึนืฉืึถื” ืœึฐืขึตื™ื ึตื™ ื›ึผึธืœ ื™ึดืฉื‚ึฐืจึธืึตืœ, and Rashi explains that this is a reference to Mosheโ€™s breaking the luchos:

Apparently, the epitome of Moshe Rabbeinuโ€™s gadlus was that he broke the luchos before the eyes of Klal Yisrael. Indeed, regarding this act Rashi uses the words ืฉื ืฉืื• ืœื‘ื• โ€“ it was a function of an uplifted heart. How do we understand this? Imagine if you promise a child a prize and he misbehaves and doesnโ€™t deserve it, and you go and destroy it in front of his eyes, breaking his toy apart piece by piece as he watches. That could be devastating to the child, and is not a good idea. Yet the Torah praises Moshe Rabbeinu for breaking the luchos specifically before the eyes of Klal Yisrael, and considers this such an incredible feat that it ends the Torah with it!

I heard the following explanation in the name of Rabbi Maggid ztโ€l of Montreal. Moshe Rabbeinu wanted Klal Yisrael to do teshuvah, but in order for them to do teshuvah, they had to first realize what they had done wrong. Had Moshe Rabbeinu simply left the luchos in shomayim and come down without them, Klal Yisrael wouldnโ€™t have fully recognized what they had lost, and they would not have been roused to do the proper teshuvah. Because Moshe Rabbeinu cared so much for Klal Yisrael, he wanted to make them feel the enormity of their cheit and realize how far it had distanced them from Hakadosh Baruch Hu and what they had lost as a result. His heart therefore uplifted him to bring down the luchos, smash them before the eyes of Klal Yisrael, and tell them, โ€œLook what you lost because of your aveirahโ€ โ€“ all this, so that Klal Yisrael would be inspired to do teshuvah.

Already in shomayim, Moshe Rabbeinu knew the kal vโ€™chomer that Klal Yisrael didnโ€™t deserve to get the luchos since they were considered mumarim with regard to the whole Torah. He brought down the luchos nonetheless, because he wanted to use them to awaken Klal Yisrael to teshuvah. That was his gadlus, and that is the Torahโ€™s final tribute to him: ืœึฐืขึตื™ื ึตื™ ื›ึผึธืœ ื™ึดืฉื‚ึฐืจึธืึตืœ.

The Power of Simchah

The second explanation is based on the Sforno. Originally, Moshe Rabbeinu thought that although Klal Yisrael did not deserve to receive the luchos, because of their cheit, he could inspire them to do teshuvah. Even though he already made the kal vโ€™chomer then, he was not yet planning to break the luchos. But then he saw something that he did not expect: ื•ึทื™ึฐื”ึดื™ ื›ึผึทืึฒืฉืึถืจ ืงึธืจึทื‘ ืึถืœ ื”ึทืžึผึทื—ึฒื ึถื” ื•ึทื™ึผึทืจึฐื ืึถืช ื”ึธืขึตื’ึถืœ ื•ึผืžึฐื—ึนืœึนืช ื•ึทื™ึผึดื—ึทืจ ืึทืฃ ืžึนืฉืึถื” ื•ึทื™ึผึทืฉืึฐืœึตืšึฐ ืžื™ื“ื• ืžึดื™ึผึธื“ึธื™ื• ืึถืช ื”ึทืœึผึปื—ึนืช ื•ึทื™ึฐืฉืึทื‘ึผึตืจ ืึนืชึธื ืชึผึทื—ึทืช ื”ึธื”ึธืจ. Not only had Klal Yisrael sinned with the eigel, but they were dancing with it. When he saw the simchah that they had with the eigel, he realized that the cheit was more serious than he had thought, and he knew that Klal Yisrael no longer deserved the first luchos because the aveirah had penetrated too deeply. He realized then that it was too late for them to do teshuvah and receive the first luchos, so he broke them.

We see from here how powerful simchah is.

The Iglei Tal famously writes in his hakdamah that when someone enjoys learning Torah, his learning is not considered shelo lishmah, but is the essence of Torah lishmah! The Torah was made to be enjoyed, and the joy of learning Torah is part and parcel of the experience. He adds a very powerful idea, which is that when a person learns Torah with joy, then the Torah is absorbed into his blood. R’ Berel Soloveitchik remarked about one of his close talmidim that when he bleeds, his blood is dam kodshim. The power of simchah is such that it penetrates into the very fiber of a human being.

From these explanations we learn two fundamental lessons. One is that real love and concern for another Jew means thinking of ways to be mechazek him to be a better eved Hashem and come closer to Hakadosh Baruch Hu. And two is that simchah is a powerful connecting force that can penetrate our very bloodstream.

 

 

The Simchah of Giving

Weโ€™re now in Chodesh Adar, the month of marbim bโ€™simchah. Rashi, in Taanis, explains that the reason for the halachah of ืžืฉื ื›ื ืก ืื“ืจ ืžืจื‘ื™ืŸ ื‘ืฉืžื—ื” is that these are days of nissim, namely Purim and Pesach. The nissim of Purim and Pesach are all included in the simchah of Adar.

In what way are we marbeh bโ€™simchah in Adar? Through bein adam lachaveiro: mishloach manos, matanos laโ€™evyonim, maโ€™os chitim. When we care for another Yid โ€“ whether physically, emotionally, or financially โ€“ that brings simchah.

The Gemara in Succah mentions two types of tefach measurements: aื˜ืคื— ืขืฆื‘ ย and a ื˜ืคื— ืฉื•ื—ืง. A ื˜ืคื— ืขืฆื‘ โ€“ a โ€œsad tefachโ€ โ€“ is measured with the fingers touching each other firmly, while a ื˜ืคื— ืฉื•ื—ืง โ€“ a โ€œhappy tefachโ€ โ€“ is measured when the fingers a spread a bit apart. When a person widens his hand to give, that brings happiness, and when a person is happy, he gives.

We should be zocheh to achieve this tremendous power of simchah by caring for another Yid, which will in turn bring more simchah and more caring for others. May Hashem help us to continue the simchah shel mitzvah of Adar that we experienced on Purim and bring it with us throughout the year.
